1. Who we are and scope
These Terms & Conditions govern your use of Quest-Hero digital treasure hunt games and related services offered via quest-hero.com and quest-hero.de. The provider is Quest-Hero (Dominik Cichon, c/o IP-Management #4463, Ludwig-Erhard-Str. 18, 20459 Hamburg, Germany). By placing an order or using our services, you agree to these terms.
Consumers in the EU/EEA, UK, or USA retain any mandatory rights provided by the laws of their place of residence; these terms do not override such protections.
2. Our services
- We provide digital, location-based treasure hunt games delivered via access codes and links.
- Each purchase grants a personal, non-transferable license to use the game for private, non-commercial purposes.
- The game remains available for at least one year from purchase; access codes are typically usable twice per game.
3. Prices, taxes, and payment
- Prices are shown on the website in the applicable currency and include or exclude taxes as displayed at checkout.
- Where required, VAT (EU/DE) or sales tax (U.S. states) is calculated and shown before purchase.
- Payment is processed in advance via Stripe. You must provide accurate billing information and have authority to use the payment method.
- We may reject or cancel orders for suspected fraud or obvious pricing errors.
4. Delivery and access
- Delivery is digital. After payment, you receive an access code and instructions by email.
- You are responsible for devices, internet access, and safe use of GPS/location features during gameplay.
- Please check spam filters and contact us if you do not receive the access email within a few minutes.
5. Refunds and right of withdrawal
- EU/EEA consumers have a 14-day withdrawal right. It expires once digital content is supplied after you have expressly requested immediate access. We inform you of this before purchase.
- As a goodwill policy, unused games can be refunded within 14 days of purchase. If a game has been fully used or played through, refunds may be declined.
- Request a refund via the refund page or by emailing[email protected] with your access code and order details.
- Statutory warranty rights remain unaffected where applicable.
6. Acceptable use and safety
- Use is personal and non-commercial. Do not resell, distribute, or publish game content.
- Do not circumvent access limits, reverse engineer, or misuse the service.
- Ensure gameplay is safe for participants and compliant with local laws, public space rules, and weather conditions.
- Our services are intended for parents/guardians purchasing for children; they are not marketed to children directly.
7. Availability and changes
We may update or improve games and the site. Temporary downtime may occur for maintenance or events outside our control. We aim to provide reasonable notice of material changes where feasible.
8. Liability
- We are liable without limitation for intent and gross negligence, and for injury to life, body, or health.
- For slight negligence, we are liable only for breach of essential contractual duties (cardinal obligations); liability is then limited to foreseeable, typical damage.
- Mandatory consumer rights and non-waivable statutory warranties remain unaffected under applicable law.
9. Governing law and disputes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in the EU/EEA, UK, or USA, you also enjoy the mandatory consumer protection of your place of residence. For merchants or customers lacking a general place of jurisdiction, the venue is Hamburg, Germany.
